This ruling follows earlier proceedings in which the court warned that the DNA process cannot be influenced by either party. This development comes months after Wunmi Aloba, Mobad’s widow, informed her father-in-law, Mr Joseph Aloba, that the DNA process cannot be manipulated, following his former counsel’s withdrawal from the case due to repeated changes in position and alleged attempts to influence the process.
According to the new court documents issued on December 2, 2025, the Magistrate struck out Mr Aloba’s most recent application after his new counsel attempted to compel the court to use two specific foreign hospitals handpicked by his team for the DNA test.
The ruling noted: “The neutrality of the DNA process must be preserved, and the selection of the testing hospitals rests solely with the Court, not with the parties, which might jeopardise the process.” The court also restated that Mr Aloba must bear the cost of the DNA test since he initiated the application.
All parties were directed to make themselves available for sample collection under the supervision of the Social Welfare Office, which will coordinate logistics and forward samples to accredited centres, including designated laboratories overseas.
Wumi’s legal team, led by S.A. Salahudeen, criticised the repeated delays caused by Mr Aloba’s shifting demands and frequent changes in legal representation.
“It has become a pattern every time the Court declines to adopt the hospital’s personally chosen by Mr Aloba, the goalpost shifts again,” the statement reads.
The matter has been adjourned to Feb 3, 2026, for administrative updates.
